If you off hand disarm the dagger from a drow patroller they do not rewield. They may not even pick it up, but I am not sure.

I'm guessing the patroller in question was blind, kotegaeshied, or otherwise unable to grab and dual wield the item in question. You don't see the 'get' because the patroller, being a dark-elf, sneaks even in combat.
